Declaration of Membership

1. Details of the declarant, hereinafter referred to as "the Declarant"

The declaration can only be sent by the person authorised to represent the prospective Member of the e-Chamber. If the declaration is not completed by:

a person authorised to represent the Declarant in accordance with the National Court Register,
or a sole trader themselves,

please prepare a power of attorney signed by the persons authorised to represent the Declarant. A scan of the signed power of attorney should be emailed to biuro@eizba.pl. A specimen power of attorney can be found below in the declaration.

In the case of the so-called multi-person representation of the company, when the declaration is completed by one of the authorised persons, please attach a scan of a power of attorney signed in accordance with the company's representation rules, from which the authority to independently submit the declaration arises. The power of attorney should be emailed to biuro@eizba.pl.

Please note that:

once the Declarant has been accepted as a Member of the e-Chamber, the above e-mail address will be used as the login for the e-Chamber online platform dedicated to Members of the e-Chamber;
the e-Chamber will make its statements, including declarations of intent addressed to the Declarant, including after their admission as a Member of the e-Chamber, using the e-mail address or telephone number of the above-mentioned person;
if you wish to change this person in the future, it is essential that you inform the e-Chamber of this fact by e-mail or in writing, providing the details of the new person.

Please note that:

This data must be updated annuallyby 15 January of the calendar year. Failure to update the data does not waive the obligation to pay the membership fee.
A new Member of the e-Chamber is obliged to pay their membership fee in full for the year in which they jointhe e-Chamber, regardless of the date of admission.
The membership fee is paid annually.

6. Declaration of accession

By submitting this DECLARATION of membership the DECLARANT:

expresses its willingness to join the Chamber of Digital Economy, with its registered office in Warsaw, and declares that it fulfils the conditions arising from Article 1 Section 4 of the Statuses of the e-Chamber;

undertakes to comply with the Statutes of the e-Chamber, the resolutions of the bodies of the e-Chamber, and the Code of Ethics;

is aware that membership of the e-Chamber entails an obligation to pay an annual membership fee and undertakes to fulfil this obligation on the terms and in the amounts laid down by resolutions of the Council of the e-Chamber;

acknowledges that it has familiarised itself with the current wording of the resolution of the Council of the e-Chamber on the amount of the membership fee as well as the time limits and rules for its collection;

acknowledges that the above resolution of the Council of the e-Chamber may be amended by the Council and that a new resolution may be adopted in this regard; and that the e-Chamber will inform the Member of this situation.

7. Representations

The person completing the declaration, indicated in item 8 of the declaration, represents that they are authorised to make the declaration on behalf of and for the benefit of the DECLARANT. The e-Chamber wishes to draw your attention to the consequences of acting on behalf of the DECLARANT without the relevant authority, which are specified in Article 103 § 3 of the Civil Code;

The person completing the declaration, indicated in item 8 of the declaration, attests to the veracity of all data indicated in this declaration.

The Declarant represents that it hereby grants a power of attorney to the person indicated in item 2 of the declaration to represent the Declarant before the e-Chamber in the matters mentioned therein, including the updating of all data of the Declarant after their acceptance as a Member of the e-Chamber, which also includes data used for the calculation of membership fees.

The Declarant represents that the aforementioned power of attorney also includes the e-Chamber’s authority to make all declarations, including declarations of intent addressed to the Declarant, with respect to the person indicated in item 2 of the declaration, also after the acceptance of the Declarant as a Member of the e-Chamber.

The Declarant represents that it wishes the e-mail address indicated in item 2 of the declaration to be used as the login address for the use of the e-Chamber online platform for e-Chamber Members; access to this platform will be made available to the Declarant once it has been accepted as a Member of e-Chamber.

The Declarant represents that, once it has been accepted as a Member of the e-Chamber, it will update all the data indicated in this declaration as soon as such changes occur.

The Declarant represents that it is aware and acknowledges that failure to update the details of the person indicated in item 2 or the other addresses provided in the declaration will result in any service made on the person indicated in item 2 of the declaration or on the addresses entered therein being deemed to be effective.

The Declarant represents that it does not have any outstanding debts under public law and that it is not currently listed or has not been listed for the past 3 years in any debtors' register.
